1. INTRODUCTION

These Terms of Use ("Terms") govern your use of the website https://www.instadham.com and the associated mobile applications ("Platform") operated by Mahakaal Techverse Private Limited ("Company", "we", "our", or "us"), having its registered office at Ground floor, Block - 8, Praneeth Blooms, Bowrampet, Telangana - 500043.

By accessing the Platform, you agree to be legally bound by these Terms and the Privacy Policy. If you do not agree with these Terms, do not use our services.

2. OVERVIEW OF SERVICES

Instadham provides a platform to digitize and enrich the pilgrimage and devotional experience for Sanatani users, offering services including:

• Audio and video spiritual content
• Pilgrimage and spiritual tour packages
• E-commerce for puja-related items
• Donation and sewa facilitation
• Temple bookings and darshan slots
• Personalized spiritual notifications

Some services may be subject to additional terms.

3. USER ELIGIBILITY

Use of our Platform is permitted to persons who:

• Are capable of entering into a legally binding agreement under the Indian Contract Act, 1872.
• Are minors with the supervision and permission of their guardian.
• Are using the services for personal and non-commercial purposes.

4. ACCOUNT CREATION

Users may log in via:

• OTP sent to mobile number
• Google, Facebook, or Apple login

Users are responsible for maintaining the confidentiality of their login credentials.

5. USER CONDUCT

You agree NOT to:

• Upload, share or comment any content that disrespects religion, temples, or spiritual figures
• Resell our services
• Post or distribute any illegal, defamatory, or infringing content
• Attempt to gain unauthorized access to other user accounts or data
• Circumvent or disable any security features

Note: Certain features may allow user-generated content. Such content will be monitored and can be taken down at our discretion.

6. PRICING AND PAYMENTS

• Pricing is variable and not fixed
• Donations, purchases and services are charged via Razorpay
• Tax amounts (if applicable) are displayed separately
• You are responsible for any data usage or telecom charges incurred

7. REFUND, RESCHEDULING & CANCELLATION POLICY

7.1 Pilgrimage Tour Packages

Refunds or rescheduling requests must adhere to cancellation policies of third-party tour operators involved. Instadham acts as a facilitator and is not liable for delays, errors, or failures by partners.

7.2 Puja Item Orders

Refunds are only accepted if:

• Wrong item was delivered
• Item is damaged
• Refund request is made within 3 days of delivery

Shipping charges may be non-refundable depending on case.

7.3 Digital Content and Donations

• Digital content (audio/video/spiritual alerts) is non-refundable
• Donation/sewa amounts once made are non-refundable unless in case of technical error

7.4 Rescheduling

Wherever applicable, users will be offered rescheduling options before refunds are processed.

8. INTELLECTUAL PROPERTY

• All content (audio, video, blogs, app layout) is owned, licensed, or aggregated from verified sources
• You agree not to reproduce, modify or distribute any of our intellectual property

9. THIRD PARTY LINKS

• We may link to YouTube, government temple websites, and verified event pages
• We are not responsible for content or terms on third-party platforms

10. SUBSCRIPTIONS AND PREMIUM FEATURES

We may offer premium plans in the future that include:

• Ad-free content
• Personalized spiritual plans
• VIP darshan or access

Terms specific to such subscriptions will be shared separately and form part of this agreement upon acceptance.

11. DISCLAIMERS

• Instadham is focused on Sanatani beliefs and does not claim religious neutrality
• No medical claims or spiritual cures are implied
• We are not liable for the accuracy of third-party or aggregated content
• Use of the platform does not guarantee salvation, health benefits, or divine outcomes

12. LIMITATION OF LIABILITY

• We are not liable for delays, loss of content, or unauthorized access beyond our control
• Our maximum liability, if any, shall not exceed the amount paid by you in the last 3 months

13. TERMINATION

We reserve the right to suspend or terminate access if:

• You violate these Terms
• Required by law
• Platform services are discontinued

14. JURISDICTION & GOVERNING LAW

These Terms shall be governed by Indian law. All disputes shall be subject to the jurisdiction of competent courts in Hyderabad, Telangana.
